Terms and Conditions

Mica's Getaways

Making a booking and taking part in any expedition, tour, or activity arranged by Mica’s Getaways (“the Company”), guests hereby acknowledge that they have read, fully understand, and agree to the following Terms and Conditions which are legally binding.

1. Assumptions of Risks and Accidents

1.1. Inherent Risks

Taking part in expeditions involves risk, including exposure to rough terrain, weather changes, marine conditions, equipment use, and physical activity.

1.2. Assumption of Responsibility

Guests hereby acknowledge that they voluntarily assume full responsibility for any risks of injury, illness, loss, or damage that may occur during the expedition.

1.3. Limitation of Liability

The Company shall not be liable for any accidents, injuries, illness, death, or loss of any personal items unless they are caused by proven gross negligence of the Company.

1.4. Guest Responsibilities

Guests are responsible for:

  • Disclosing any medical conditions that may interfere with participation

  • Follow all safety instructions provided by Mica’s Getaways staff

  • Wear compulsory safety equipment at all times

1.5. Barring from an Expedition

The Company reserves the right to bar any guest from an expedition if their behavior poses a risk to themselves or others, without refund being provided.

2. Refund / Cancellation

2.1. Guest-requested cancellations

Refunds are always subject to Mica’s Getaways cancellation timeline and could include administrative fees. No refunds will be issued for “no-shows” or early guest departure from an expedition.

  • 100% refund if canceled 10 days or more before the departure date

  • 50% refund if canceled 5–9 days before the departure date

  • No refund for cancellations made within 5 days of the departure date

2.2. Company-responsible cancellations

If Mica’s Getaways cancel an expedition because of safety concerns, operational issues, or weather conditions, guests may accept:

  • A full refund, or

  • Rescheduling to another expedition at a future date (subject to availability)

2.3. Non-Refundable Costs

Mica’s Getaways shall not be responsible for any consequential expenses such as transportation, accommodation, meals, or personal arrangements made by the guest.

3. Weather Conditions / Force Majeure

3.1. Weather and Natural Factors

Expeditions are subject to weather, sea conditions, and natural factors beyond the Company’s control.

3.2. Changes to Itinerary

Mica’s Getaways reserves the right to:

  • Change routes, schedules, or activities

  • Delay, postpone, reschedule, or cancel an expedition

  • Substitute activities that are of equal value when possible

3.3. Weather / Refunds

Challenging weather conditions do not automatically guarantee a refund, unless the expedition is canceled entirely by Mica’s Getaways.

4. Acceptance of Terms

By confirming a booking and taking part in any expedition, guests hereby confirm that they:

  • Agree to these Terms and Conditions

  • Accept responsibility for their participation

  • Unequivocally release Mica’s Getaways from claims except where prohibited by law.

3.4. Force Majeure

Mica’s Getaways shall not be liable for delays, interruptions, or cancellations caused by events beyond Mica’s Getaways reasonable control, including but not limited to:

  • Severe weather conditions

  • Natural disasters

  • Government-imposed restrictions

  • Mechanical and/or safety issues

Marketing Photo/Video Consent (optional)

I consent to Mica’s Getaways Tourist Boat Rental (and its staff, contractors, and agents) capturing and using my image and likeness in photos and videos taken during my tour, including content captured by boat crew, marketing staff, and aerial drones, for the company’s marketing purposes (e.g., website, social media, digital ads, brochures, and press). I understand I will not receive compensation, that the materials may be edited, combined with other media, and used worldwide and for an unlimited time, and that my name will not be used unless I give additional written permission. I can withdraw consent for future uses by emailing [privacy@micasgetaways.com], but withdrawal won’t affect content already produced or published based on my prior consent or where the company has a legitimate interest or legal obligation to keep using it.
